Abstrakt: As you know, Ukraine now is at war with the Russian Federation. Decree of the President of Ukraine № 64/2022 introduced the imposition of martial law in Ukraine, which may restrict a number of constitutional rights and freedoms of human and citizen, as well as introduce temporary restrictions on the rights and legitimate interests of legal entities within the scope for military action. This includes the right to privacy, secrecy of correspondence, telephone conversations and other forms of communications, the right to freedom of thought and speech, the free expression of one's views and beliefs, the right to move, the right to peaceful assembly and much more. Today I would like to focus on the human right to image. This topic applies to absolutely everyone from the average person to a professional and a public figure. We will consider the various rights that arise to the image. 1. The right to image - as part of confidential personal information and privacy. Who can shoot a person on film, TV or video and under what conditions. Who can use: reproduce, publicly display and distribute human images. How is the right to an image of a public person or celebrity exercised? 2. Intellectual property rights to the image. Copyright and Terms of Use. The doctrine of fair use. Images and social networks, rules for using images on the Internet. Creative use of images (reworking, derivative art work, caricatures). Use of images in advertising. 3. Rights of photographers and correspondents. Shooting places, places called public and social places. Open shooting on the street, shooting at public events. Shooting architectural objects. Shooting during the war. A presentation and case studies will be used during the lecture.
